Privacy Statement

This statement is the privacy policy of David Harney Constructions Pty Ltd (hereafter “we” or “us”). This statement outlines our policy about how we manage personal information. From time to time we may find it necessary to change this Privacy Statement to reflect changes in the law or our commercial activities. The latest version of our Privacy Statement will always be available on our website. We are bound by the Australian Privacy Principles and our procedures regarding personal information are designed to ensure that your rights under the Australian Privacy Principles are protected.

Your information

We may collect personal information as defined under the Privacy Act 1988 (Cth) directly from you during the course of your conduct with us. We may also collect information about you from third parties who are involved in any transaction to which you are a party, including your financier or professional advisers, as well as from publicly available sources of information. Such information may include your name and contact details (including address, telephone numbers and email address), property ownership details, as well as the details of your enquiries with us. This is not an exhaustive list and we may collect additional information from you in the course of your contact with us. The Privacy Act defines certain kinds of information as sensitive information, which includes information about a person’s race, health, religious beliefs and criminal history. We would not typically collect such information, however, sensitive information would only be collected with your permission and used only for the purpose for which you provided it.

If you provide us with personal information about other individuals then we will rely on you to inform those individuals that you are providing to us such personal information and to advise them of this statement.

Why do we collect your information?

We collect personal information in the course of our business for a variety of reasons including:

  • To keep ourselves informed of prevailing business conditions
  • To identify and market our services
  • To draw up contracts for our services

We also collect personal information about persons who:

  • Apply to us for employment; or
  • Are involved in the supply of goods and services to us.

We may store your information in hard copy or electronic format, in storage facilities that we own and operate ourselves, or that are owned and operated by our service providers. We will use reasonable endeavours to maintain the security of your information under our control. We use a combination of processes to help us protect your information and our network from unauthorised access and disclosure. While we take these steps to maintain the security of your information, you should be aware of the security risks that exist today and take appropriate care to help safeguard your information. We may keep personal information for at least 7 years after the completion of a transaction for legal reasons.

We will be open about how we handle personal information. We will do this by:

  • Telling you when we collect personal information, what we will use the information for and to whom we may disclose it.
  • Giving you more detailed explanation of our privacy policy when you ask for it.
  • Giving you access to personal information that we hold about you when you ask for it.

You have the right to access personal information that we hold about you under the Australian Privacy Principles and to request that the information be corrected if necessary. Details of how to make a request for access are set out at the end of this Privacy Policy. We may charge you a small fee to cover any costs which we incur responding to your request for access such as photocopying costs or facsimile charges.

To whom do we disclose personal information?

We may need to disclose personal details to various people to carry out the services that we are engaged to provide. For example we may need to give details about the owner of land to local authorities and building certifiers. We may disclose personal information from time to time to other persons, including land developers, to provide introductions of purchasers. We will seek your consent before passing on your personal information in this way.

How do we make sure that information is accurate, complete and up to date?

We try to ensure that any personal information that we hold is accurate and current. We do this by collecting information from you directly or from reliable sources including publicly accessible databases. If we become aware that the information is inaccurate, incomplete or out of date we will correct that information or delete it from our records.

then you may contact our Privacy Officer on 1800 HARNEY (427 639). We will respond to an inquiry or complaint promptly (usually within 14 to 30 days).
